释义	劳动合同的终止与劳动合同的解除是两个完全不同的法律概念。根据劳动部有关规定，劳动合同的解除是指劳动合同订立后，尚未全部履行以前，由于某种原因导致劳动合同一方或双方当事人提前消灭劳动关系的法律行为。劳动合同的解除分为法定解除和约定解除两种。而劳动合同的终止，是指劳动合同期限届满或者有其他符合法律规定的情形出现导致劳动合同关系消灭。按照《劳动合同法》规定，劳动合同的终止只有法定情形的终止，而不能有约定条件下的终止，否则，即使约定了，也是无效的。
