释义	法律分析：包方提起诉讼要求发包方退还保证金，应当依照定金法律关系的要求来确定案由，从而其管辖也应适用一般的合同纠纷的管辖，而不适用建设工程施工合同专属管辖。法律依据：《建设工程质量保证金管理》第十条有对工程质保金的具体规定，当建设单位在接到施工单位返还保证金申请后，应于14日内会同施工单位按照合同约定的内容进行核实。如无异议，建设单位应当在核实后14日内将保证金返还给施工单位，逾期支付的，从逾期之日起，按照同期银行贷款利率计付利息，并承担违约责任。
