释义	法律分析: 证人只能是当事人以外知道案件情况的人只有知道案件情况的人，才能作为证人，但知道案件情况的人，并非都是证人。案件的当事人由于与案件有直接利害关系。因此不能作为证人。法律依据: 《中华人民共和国民事诉讼法》第七十三条经人民法院通知，证人应当出庭作证。有下列情形之一的，经人民法院许可，可以通过书面证言、视听传输技术或者视听资料等方式作证：（一）因健康原因不能出庭的；（二）因路途遥远，交通不便不能出庭的；（三）因自然灾害等不可抗力不能出庭的；（四）其他有正当理由不能出庭的。
