保障合同和无保障合同的区别

释义

法律主观：

无保障合同有工资的。没有劳动合同 ,用人单位拖欠工资或者克扣工资 ,劳动者可以到用人单位所在地的劳动争议仲裁委员会申请劳动仲裁。工资是指雇主或者法定用人单位依据法律规定、或行业规定、或根据与员工之间的约定，以货币形式对员工的劳动所支付的报酬。

法律客观：

《劳动法》第五十条工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。
