释义	法律分析：公民死亡后权利消灭，故死人没有肖像权。但是其肖像、姓名等仍在一定期限内受法律保护，其肖像权受到不法侵害时，由其近亲属向人民法院起诉救济。法律依据：《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》第四条死者肖像受法律保护。自然人死亡后，他人以侮辱、诽谤、贬损、丑化或者违反社会公共利益、社会公德的其他方式，侵害死者姓名、肖像、名誉、荣誉；其近亲属因该侵权行为遭受精神痛苦，向人民法院起诉请求赔偿精神损害的，人民法院应当依法予以受理。
