问题	能否同时约定定金和违约金
释义	法律分析: 合同中能同时约定定金和违约金，但是二者不能同时适用。当事人要选择其中一种来主张。不能同时主张。如果当事人选择定金的，在定金不足以弥补一方违约造成的损失的情况下，当事人还可以请求对方赔偿超过定金数额的损失。法律依据:《《中华人民共和国民法典》》第五百八十八条【违约金与定金竞合时的责任】当事人既约定违约金，又约定定金的，一方违约时，对方可以选择适用违约金或者定金条款。定金不足以弥补一方违约造成的损失的，对方可以请求赔偿超过定金数额的损失。
