释义	担保人与保证人的区别是什么保证是指保证人和债权人约定，当债务人不履行债务时，保证人按照约定履行债务或者承担责任的行为，也就说说，保证人作保证时，是以个人信用为债务人作担保;而担保是指债务人或第三人和债权人约定以某财产作为担保，当债务人不履行债务时，债权人有权以该财产折价或者以拍卖、变卖该财产的价款中优先受偿的行为，也就是说，担保是以设定物作担保的。不过，担保人又包括：抵押人、留置人、定金支付人、保证人，因此担保人又包括保证人。
