释义	法律分析：当事人一方明确表示或者以自己的行为表明不履行合同义务的，对方可以在履行期限届满前请求其承担违约责任。预期违约又被称作先期违约，包括明示毁约和默示毁约。当事人在合同履行期到来之前无正当理由明确表示将不履行合同，或者以自己的行为表明将不履行合同，即构成预期违约。法律依据：《中华人民共和国民法典》第五百七十八条当事人一方明确表示或者以自己的行为表明不履行合同义务的，对方可以在履行期限届满前请求其承担违约责任。
