释义	法律分析：冤狱赔偿是指由于司法机关误判、错判而导致个人合法权益损害时，依法由国家给予赔偿的制度。国家赔偿的一种。特点：（1）因司法机关及审判人员在司法审判过程中误判错判造成公民合法权益损害而发生；（2）由造成损害的司法机关承担；（3）—般不另外单独提起赔偿诉讼，而是由受侵权损害人在刑事上诉程序中提出赔偿的请求，或者向作出刑事判决的原审法院提出赔偿请求。法律依据：《中华人民共和国国家赔偿法》第三十三条侵犯公民人身自由的，每日赔偿金按照国家上年度职工日平均工资计算。
