释义	单位犯罪必须是法人单位吗《刑法》中单位犯罪是不要求有法人资格的，即与法人资格无关，与法律是否规定有关。我国单位犯罪时有严格的法定性的，即法律规定的情形才能成立单位犯罪的。法律没有规定其为单位犯罪的只能按个人犯罪处理。单位犯罪的要件为： 1、以单位的名义； 2、犯罪利益归单位共同享有。如果明确法律规定某非法人资格的主体犯罪为单位犯罪的，只要是以单位名义实施，利益归单位，也构成单位犯罪。如果没有明文规定，无法人主体资格的独资、私营企业犯罪的为个人犯罪。
