释义	法律分析：理论上来说是不可以买的。私人建的没有房产证的房屋，这类房屋要么是违章建筑，要么是不允许交易的建筑。从法律角度来说，这套房子并不属于你;同时如果有拆迁等，你也不会得到任何补偿。法律依据：《中华人民共和国土地管理法》第五条农村宅基地属集体所有，村民对宅基地只享有使用权，农民将房屋卖给城市居民的买卖行为不受到法律的认可与保护，即不能办理土地使用证、房产证、契税证等合法手续。因此，小产权房不能向非本集体成员的第三人转让或出售，只能在集体成员内部转让、置换。
