释义	不违法。《民法典》规定，任何组织或者个人不得侵害他人的隐私权，任何个人包括配偶，所以未经配偶同意偷看其手机违法。但法律同时还规定，夫妻之间负有忠实义务，在对方出轨时，受害方不得以偷看手机手机证据以维护是合法权利，属于类似正当防卫一样的私力救济行为并不违法。如果证据被随意公开宣扬就是违法。
