法律依据：《中华人民共和国诉讼费用交纳办法》 第三十四条 民事案件的原告或者上诉人申请撤诉，人民法院裁定准许的，案件受理费由原告或者上诉人负担。行政案件的被告改变或者撤销具体行政行为，原告申请撤诉，人民法院裁定准许的，案件受理费由被告负担。
