释义	按照现行刑法的规定，防卫过当应当负刑事责任。负刑事责任的前提是构成犯罪，而犯罪行为具有主、客观两方面的特征，除了客观方面实施了危害社会的行为之外，行为人应该是有过错的，故意或者过失。不难看出，这种主观过错的证明难度极大，因为刑法很多犯罪的客观表现几乎没有什么区别，只能结合不法侵害人的主观方面才能进行辨别。故意伤害致人死亡和故意杀人既遂的客观表现可能完全一样，只是主观故意内容不同。法律依据《中华人民共和国刑法》第二十条
