释义	非法占用的土地要责令退还。对已建的建筑物及设施,符合土地利用总体规划的,要予以没收:不符合土地利用总体规划的,要予以拆除。除此之外,可以并处罚款。罚款数额为非法占用土地的每平方米30元以下。法律依据: 《中华人民共和国刑法》第四百一十条国家机关工作人员徇私舞弊，违反土地管理法规，滥用职权，非法批准征收、征用、占用土地，或者非法低价出让国有土地使用权，情节严重的，处三年以下有期徒刑或者拘役；致使国家或者集体利益遭受特别重大损失的，处三年以上七年以下有期徒刑。
