留置权的效力是高于抵押权和质权的吗
释义
留置权与抵押权、质权冲突时效力最高。因为我国《民法典》规定，同一动产上已经设立抵押权或者质权，该动产又被留置的，留置权人优先受偿。由此可见，留置权的效力是高于抵押权和质权的。
所谓留置权，是指债权人因合法手段占有债务人的财物，在由此产生的债权未得到清偿以前留置该项财物并在超过一定期限仍未得到清偿时依法变卖留置财物，从价款中优先受偿的权利。
【法律依据】
《民法典》第四百五十六条，同一动产上已经设立抵押权或者质权，该动产又被留置的，留置权人优先受偿。
