一般情况下，嫖娼属于违法行为，因此即使会给予行为人一定的处罚，但绝对不会是刑事方面的处罚，而属于行政处罚，主要涉及到拘留和罚款，其中拘留最长不能超过15天。
【法律依据】：
《中华人民共和国治安管理处罚法》第六十六条 卖淫、嫖娼的，处十日以上十五日以下拘留，可以并处五千元以下罚款节较轻的，处五日以下拘留或者五百元以下罚款。在公共场所拉客招嫖的，处五日以下拘留或者五百元以下罚款。
