法律分析：
目前副驾驶的乘客没有年龄方面的限制和处罚，但是儿童坐在副驾驶的位置是不安全的。对于副驾驶座上乘客的要求则要参照《中华人民共和国道路交通安全法》中的第四章第五十一条中的规定：副驾驶座乘客没系安全带的，对该乘客处以五元以上五十元以下罚款。
法律依据：
《中华人民共和国道路交通安全法》 第五十一条 机动车行驶时，驾驶人、乘坐人员应当按规定使用安全带，摩托车驾驶人及乘坐人员应当按规定戴安全头盔。
