释义	代位权,是指债权人为保全其债权,而于债务人怠于行使自己的权利而害及债权人债权实现时,得以自己的名义代位行使属于债务人权利的权利。代位求偿权,是指当保险标的遭受保险事故造成的损失,依法应由第三者承担赔偿责任时,保险公司自支付保险赔偿金之日起,在赔偿金额的限度内,相应取得向第三者请求赔偿的权利。代位权适用于担保法，而代位求偿权适用于保险法。他们分别适用范围不同的法律关系，不是同一权利。法律依据《民法典》第五百三十五条第七百一十九条
