双方共同违约时的责任划分是怎样的

法律分析：合同双方违约责任按各自的过错大小划分，即过错大的一方当事人承担主要的违约责任，过错小的另一方当事人则承担次要的违约责任。双方过错相当，或者不能确定双方过错大小的，双方平均分担违约责任。仅一方存在过错的则由过错的一方承担全部违约责任
法律依据：《中华人民共和国民法典》 第五百七十七条 当事人一方不履行合同义务或者履行合同义务不符合约定的，应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
