释义
要看未成年是否满十四周岁。我国《刑法》对于幼女的认定标准是不满十四周岁。针对实践中同幼女发生性关系的案件，《刑法》规定：行为人明知是不满十四周岁的幼女而与其发生性关系，不论幼女是否自愿，均应依照《刑法》第二百三十六条第二款的规定，以强奸论，从重处罚。
