释义	根据《劳动合同法》规定，本法施行前已建立劳动关系，尚未订立书面劳动合同的，应当自本法施行之日起一个月内订立。这一规定明确了，新法实施前已经存在事实劳动关系的双方应在新法实施后及时补签书面劳动合同，最迟应在新法实施之日起1个月内补签书面的劳动合同。也就是说，从2008年1月1日开始到2月1日之前，所有未与劳动者签订劳动合同的用人单位，必须抓紧时间签订劳动合同，否则将受到相应的处罚，即向劳动者每月支付两倍的工资。
