释义	我国并没有个人破产制度，所以不存在个人破产的问题，因此除非债务人死亡:且没有留下遗产的,否则不论什么时候债务人都是需要还债的。如果债务人死亡的，也需要用其留下的遗产来还债，如果其遗产被继承人继承了的，则需要继承遗产的继承人来还债。【法律依据】《民法典》第一千一百五十九条，分割遗产,应当清偿被继承人依法应当缴纳的税款和债务;但是，应当为缺乏劳动能力又没有生活来源的继承人保留必要的遗产。
