释义	法律分析：尽管我国关于该类纠纷相继出台了一系列法律规范，但关于以房抵债的行为性质认定仍然没有统一的定论，各地的司法实践中关于以房抵债的结论认定也出现了不同观点而同案不同判，不但无法保障公平正义，而且还会降低司法机关的社会公信力。法律依据：《城市房地产抵押管理办法》第三条在建工程抵押，是指抵押人为取得在建工程后续资金的贷款，以其合法方式取得的土地使用权连同在建工程的投入资产，以不转移占有的方式抵押给贷款银行作为偿还贷款履行担保的行为。
