释义	法律分析：根据《民法典》第一千一百二十二条规定，遗产是指公民死亡时遗留的个人合法财产，包括公民的收入、房屋和其他合法财产。也就是说遗产必须符合三个条件： 1、必须是公民死亡时遗留的财产; 2、必须是公民个人所有的财产; 3、必须是合法财产。只有同时具备这三个条件才能成为遗产。因房屋承租人并不是公有房屋的所有人，对该房屋只有居住使用的权利而无所有权，不属于其个人合法财产。承租人若是在房屋拆迁前身故，因为原承租人身份无法获得的补偿，这一身份利益也无法作为遗产分割。
