中华人民共和国刑法煽动民族歧视罪立案规定：本罪是行为犯，只要行为人实施了煽动民族仇恨、民族歧视的行为，原则上就构成犯罪，应当立案侦查。煽动民族仇恨、民族歧视罪，是指煽动民族仇恨、民族歧视，情节严重的行为。煽动民族仇恨、民族歧视罪的客体是民族仇恨和民族歧视。
