释义	当事人已婚，与他人同居是否构成重婚罪，要依据实际情况而定：（1）如果当事人已经结婚，以夫妻的名义与他人同居，属于重婚的行为，会构成重婚罪; （2）如果只是同居，没有构成重婚行为的，不会构成重婚罪。重婚罪是指行为人违反我国刑法的有关规定，在有合法配偶的情况下又与他人结婚或者明知他人有配偶而与之结婚所构成的犯罪。【法律依据】《刑法》第二百五十八条，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
