释义	刑法第27条第2款规定：“对于从犯，应当从轻、减轻处罚或者免除处罚。”从犯的刑事责任是同主犯应负的刑事责任相比较而言，比主犯应受到的刑罚处罚要轻。但也不是说，所有的从犯实际受到的处罚一定比主犯轻。因为主犯可能具有从轻或者减轻甚至免除处罚的情节(例如自首)，当从犯没有这样的情节时，当然不应随主犯的从轻、减轻或免除处罚而从轻、减轻或免除处罚。
