释义	本罪侵犯的客体是我军的俘虏管理制度。我军对放下武器的敌军官兵，实行宽待政策，给予人道待遇，不杀不辱，不没收私人财物，受伤给予治疗，妥善处理死亡俘虏的遗体和遗物。这是我军瓦解敌军的政治工作原则的具体体现。我军不仅在战场上历来奉行宽待俘虏的政策，而且我国还于1956年I1月5日批准加入《关于战俘待遇的日内瓦公约》。虐待俘虏的行为直接侵害了我军的俘虏管理制度，削弱了我军俘虏政策的威力，损害了我军的声誉，使敌人的反动宣传有机可乘，导致敌人顽抗到底，增加了我军夺取胜利的困难。
