释义	法律分析：本罪在主观方面表现为故意。即行为人明知自己虐待俘虏的行为破坏了俘虏管理秩序，将会对我军作战造成危害，却希望或者放任这种危害结果发生。过失不构成本罪。虐待俘虏的动机多为义愤、敌意和报复心理，不论出于何种动机，情节恶劣的均构成虐待俘虏罪。法律依据：《中华人民共和国刑法》四百四十八条虐待俘虏，情节恶劣的，处三年以下有期徒刑。
