释义	法律分析：无效，并且重婚还属于犯罪行为。根据我国刑法的规定，有配偶而重婚的，或者明知他人有配偶而与之结婚的，处2年以下有期徒刑或者拘役。因此，对于婚外情一方，重婚罪肯定是要判刑的，即使是拘役，也属于刑事处罚。对于明知他人有配偶而与之结婚的，也是触犯刑法的。也就是说，对于那些情愿做婚外情的第三者的，也可能触犯刑法，受到刑事处罚。法律依据：《中华人民共和国民法典》第一千零五十一条有下列情形之一的，婚姻无效：（一）重婚；（二）有禁止结婚的亲属关系；（三）未到法定婚龄。
