释义	驳回起诉案件二审可以调解吗二审法院对裁定驳回的上诉案件进行调解,不仅有法可依,也可以提高审判效率,同时也能大大降低诉讼成本根据最高人民法院发布的《关于执行〈中华人民共和国刑事诉讼法〉若干问题的解释》第263条规定对第二审自诉案件，必要时可以进行调解，当事人也可以自行和解。调解结案的，应当制作调解书，第一审判决、裁定视为自动撤销;当事人自行和解的，由人民法院裁定准许撤回自诉，并撤销第一审判决或者裁定。
