释义	法律分析：在实践中能够退回定金情况有以下3种：（1）签订合同的另一方违约，可以双倍要回定金；（2）因不可抗力导致合同不能履行的，可以要求返还定金；（3）因为第三人原因导致合同不能履行或未能如约履行的，可以要回双倍定金，但另一方给付定金后，可以向第三人追偿。法律依据：《中华人民共和国民法典》第五百八十七条收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。
