释义	不起诉处理就是无罪吗一般来说是不会判刑的，没有判刑也就不会有罪。不起诉，是指人民检察院在审查起诉后做出不将案件移送人民法院审判而终止诉讼的决定。根据《刑事诉讼法》第171、173条的规定，人民检察院认为犯罪嫌疑人依法不应追究刑事责任的，应当作出不起诉的决定;对于犯罪情节轻微，依照刑法规定不需要判处刑罚或者免除刑罚的，人民检察院可以作出不起诉的决定;对于补充侦查的案件，人民检察院仍然认为证据不足，不符合起诉条件的，可以作出不起诉的决定。
