本罪的犯罪构成。（一）客体要件。本罪侵犯的客体是国家重点保护的珍贵、濒危野生动物的管理制度。（二）客观要件。本罪在客观方面表现为非法猎捕、杀害国家重点保护的珍贵、濒危野生动物的行为。非法捕杀珍贵、濒危野生动物的行为方式多种多样，但可以归纳为3类：猎取珍贵、濒危的陆生野生动物，捕捞珍贵、濒危的水生野生动物，杀害珍贵、濒危的陆生或水生野生动物。到于其捕杀行为是在何时、何地、用何种工具，采用何种方法都不影响本罪的成立。实践中具有非法猎捕和杀害两种方式之一的，即可构成本罪，同时具备两种方式的，也只构成一罪，不能按数罪并罚。本罪属于行为犯，只要行为人实施了非法捕杀珍贵、濒危野生动物的行为，就构成犯罪。不以其是否具备情节严重作为划分罪与非罪的界限。非法捕杀珍贵、濒危野生动物罪的既遂，以符合本罪的构成要件为标准。只要完成猎取、捕捞、杀害行为之一的，构成既遂。是否杀害珍贵、濒危野生动物并非本罪既遂的唯一标志。（三）主体要件。本罪的主体为一般主体，即凡是达到刑事责任年龄具有刑事责任能力的人，均可构成本罪。单位也可成为本罪主体。（四）主观要件。本罪在主观方面表现为故意，过失不构成本罪。行为人可能是为了出卖牟利、自食自用、馈赠亲友或者出限取乐的目的，都可以构成本罪。
