释义	法律分析: 国家实行带薪年休假制度。机关、团体、企业、事业单位、民办非企业单位、有雇工的个体工商户等单位的职工连续工作1年以上的，享受带薪年休假。法律依据: 《中华人民共和国劳动法》第四十五条国家实行带薪休假制度，劳动者连续工作1年以上享受带薪休年假。劳动者必须是在用人单位连续工作满一年的，才能享受带薪休年假。若劳动者在用人单位工作未满一年，或者劳动者在用人单位工作虽满一年但不是连续工作一年以上的，都不能享受带薪休年假。
