释义	根据《最高人民法院关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》第十条第二款规定，网上图片侵权被侵权人损失额不能确定的，法院依被侵权人的请求，可以根据侵害情节在人民币500元以上30万元以下确定赔偿数额，最多不得超过人民币50万元。《中华人民共和国著作权法》第四十八条规定：侵犯著作权或者与著作权有关的权利的，侵权人应当按照权利人的实际损失给予赔偿;实际损失难以计算的，可以按照侵权人的违法所得给予赔偿。
