分包合同可以与分公司签订么？
释义
可以，前提是分公司领取了营业执照。分公司虽然不是独立的法人，但是一般也是领取营业执照了的，可以在总公司的授权范围内从事经营活动，可以对外签订合同。而且可以自己的名义对外签订合同，就是并不一定需要盖总公司公章，可以盖分公司自己的公章。
法律依据：
《中华人民共和国公司法》 第十四条 公司可以设立分公司。设立分公司，应当向公司登记机关申请登记，领取营业执照。分公司不具有法人资格，其民事责任由公司承担。
