释义	购房定金可以退，但要符合法定情形才可以退。一、法律依据。我国《商品房销售管理办法》第22条规定：不符合商品房销售条件的，开发商不得销售商品房也不得收取任何预订款性质的费用。因此，如果商品房不符合销售条件，而购房者已经交纳了定金，那么无论双方是否约定定金退还事项，开发商都应无条件退还定金给购房者。二、具体情形。符合退还定金的情形有两种。1、开发商没有销售资质(如：没有预售许可证)，法律是支持退还定金的。2、如果是你和开发商因为合同里的条款没有达成一致，合同签订失败，购房定金也是要退还的。
