一、驱逐出境由什么部门决定
1、对违反治安管理的外国人，驱逐出境由公安部或者公安部授权的省级人民政府公安机关决定。
2、法律依据：《中华人民共和国出入境管理法》
第六十二条 外国人有下列情形之一的，可以遣送出境：
(一)被处限期出境，未在规定期限内离境的;
(二)有不准入境情形的;
(三)非法居留、非法就业的;
(四)违反本法或者其他法律、行政法规需要遣送出境的。
其他境外人员有前款所列情形之一的，可以依法遣送出境。
被遣送出境的人员，自被遣送出境之日起一至五年内不准入境。
二、作为刑罚的驱逐出境与作为行政措施的驱逐出境有什么不同
1、处罚的性质和适用的对象不一样。刑法规定的驱逐出境，是一类刑事处罚，适用于在中国境内犯罪的外国人。外国人入境出境管理法规定的驱逐出境，是一类行政处罚方式，适用于违背入境出境管理的外国人。
2、主管机关和适用的法律依据不一样。做为附加刑的驱逐出境，由人民法院按照刑法和刑事诉讼法的规定判处;而做为行政处罚的驱逐出境，则由地方公安部门按照《外国人入境出境管理法》和其它有关规定，报告公安部，由公安部做出决策。
