释义	法律分析: 借新还旧的情况下担保人一般不需要承担责任，借新还旧作为商业银行在贷款的发放和收回过程中经常采用的操作方式，是指贷款到期后不能按时收回，又重新发放贷款用于归还部分或全部原贷款的行为，但是如果之前的担保人同意为新的贷款担保，则对于新的贷款也是要承担担保责任的。《中华人民共和国民法典》第六百八十六条保证的方式包括一般保证和连带责任保证。当事人在保证合同中对保证方式没有约定或者约定不明确的，按照一般保证承担保证责任。
