释义	法律分析：二胎是需要办理准生证的。国家卫计委早已经明确地规定，全面实施两孩生育的新政策之后，取消二孩审批，实行生育登记服务制度。也就是说，一对夫妻生育第二个子女的，不再发放二胎准生证。生育第二个孩子的夫妻，可到一方的户口所在地或者是现居住地办理登记。具体登记办法由各省市进行制订。法律依据：《中华人民共和国宪法》第二十五条国家推行计划生育，使人口的增长同经济和社会发展计划相适应。
