释义	子女不赡养父母的构成遗弃罪的，会被处五年以下有期徒刑、拘役或者管制。子女不履行赡养义务，情节严重的父母可以自行提出刑事诉讼或者向公安机关报警提起公诉，法院在进行审理后，认为构成遗弃罪的，会依法对不负赡养义务的子女判处刑罚。法律依据：《中华人民共和国刑法》第二百六十一条遗弃罪对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
