有待业证退休时算工龄吗？

法律分析：
待业期间不算工龄。待业,是指劳动者接受完教育后却没找到工作,等待工作机会的做法。工龄,是指劳动者以自己的薪水收入作为生活资料的主要或者全部来源的期间。待业期间,无工作,也无薪水收入,不能计量工龄。
法律依据：
《劳动保险条例》 第三十八条 通常工龄系指工人员工以薪水收入为生活资料之全部或主要来源的工作时间而言。在计量通常工龄时，应包括本公司工龄在内。
