释义	配资是否构成非法经营罪，需要界定两个要素：(一)股票配资是否属于证券业务;(二)是否经过证监会的批准。《刑法》第二百二十五条规定：未经国家有关主管部门批准非法经营证券、期货业务，扰乱市场秩序，情节严重的，构成非法经营罪。最高人民法院、最高人民检察院、公安部、中国证券监督管理委员会关于整治非法证券活动有关问题的通知明确：“任何单位或个人经营证券业务必须经证监会批准，未经批准的，属于非法经营证券业务，应予以取缔;涉嫌犯罪的，以非法经营罪追究刑事责任。”
