释义	法律分析: 偷电行为是在“规避他人管控”的情况下改变了电力系统形态， (1)使按合同设置的电能表不能正确计量，截留应付给对方的电费，侵权时往往对方未察觉，属于盗窃，又属于违约行为，达到一定数额属于盗窃罪； (2)无合同关系私自盗取电能，属于盗窃，达到一定数额属于盗窃罪。法律依据: 《中华人民共和国电力法》第七十一条盗窃电能的，由电力管理部门责令停止违法行为，追缴电费并处应电费五倍以下的罚款;构成犯罪的，依照刑法第一百五十一条或者第一百五十二条的规定追究其刑事责任。
