释义	法律分析：盗墓是犯法的。如果是一般的盗墓行为，如果是情节较轻的会判处三年至是十年的有期徒刑，要是情节严重的会在十年以上。若是为盗取全国重点文物保护单位，省级以上文物保护单位的古文化遗址或者古墓葬的，视情节严重程度等等。法律依据：《中华人民共和国刑法》第三百二十八条盗掘具有历史、艺术、科学价值的古文化遗址、古墓葬的，处三年以上十年以下有期徒刑，并处罚金;情节较轻的，处三年以下有期徒刑、拘役或者管制，并处罚金。
