释义	1、首先要有两块土地，即需役地和供役地的同时存在，这是地役权成立的前提; 2、必须是为了给利用自己的土地提供便利，也就是为了需役地的便利; 3、必须是使用他人的土地; 4、地役权具有从属性和不可分性，必须与需役地的所有权或者使用权一起转移，不能与需役地分离而转让，也不得与需役地分离而成为其他权利的标的。【法律依据】《民法典》第三百七十二条，地役权人有权按照合同约定，利用他人的不动产，以提高自己的不动产的效益。前款所称他人的不动产为供役地，自己的不动产为需役地。
