释义	法律分析：不是。哺乳期是指产后产妇用自己的乳汁喂养婴儿的时期，就是开始哺乳到停止哺乳的这段时间，一般长约10个月至1年左右。在这期间对于刑事责任人通常采取取保候审或者监外执行的方式。法律依据：《中华人民共和国刑事诉讼法》第二百一十四条对于被判处有期徒刑或者拘役的罪犯，有下列情形之一的，可以暂予监外执行： (一)有严重疾病需要保外就医的; (二)怀孕或者正在哺乳自己婴儿的妇女。这不是没有服刑，而是因为条件特殊，怀孕或者哺乳的在监狱外边执行，执行时间也计算在刑期内。
