释义	法律分析：在实践中分两种情况，如果保证人在主债务到期后死亡的，要承担保证责任。如果债务到期前死亡的，不承担保证责任。法律依据：《中华人民共和国民法典》第六百八十一条保证合同是为保障债权的实现，保证人和债权人约定，当债务人不履行到期债务或者发生当事人约定的情形时，保证人履行债务或者承担责任的合同。第六百九十三条一般保证的债权人未在保证期间对债务人提起诉讼或者申请仲裁的，保证人不再承担保证责任。连带责任保证的债权人未在保证期间请求保证人承担保证责任的，保证人不再承担保证责任。
